1. Acceptance of Terms

By accessing, registering for, or using PulsePeak Management ("Service", "Platform"), you ("User", "you") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with these Terms, you must not use the Service.

2. Description of Service

PulsePeak Management is a social media content management platform that allows content creators and social media managers to:

• Connect and manage multiple social media accounts (Instagram, TikTok, YouTube)
• Schedule and automatically publish video and image content
• Track content performance and follower analytics
• Organize content via Google Drive integration

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal authority to enter into these Terms.

4. Account Registration

To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

5. Third-Party Platform Integration

The Service integrates with third-party social media platforms including TikTok, Meta (Instagram, Facebook), YouTube, and Google Drive via their official APIs. By connecting these platforms to PulsePeak, you:

• Authorize PulsePeak to access and act on your behalf within the scopes granted during the OAuth authorization flow
• Agree to comply with the respective platform's terms of service, including the TikTok Terms of Service, Instagram Terms of Use, and YouTube Terms of Service
• Acknowledge that you can revoke this access at any time via the PulsePeak dashboard or directly within the platform's settings

6. Content Ownership and License

You retain all ownership rights to the content you upload, schedule, or publish via the Service. By using PulsePeak to publish content, you grant us a limited, non-exclusive license to:

• Process and transmit your content to the connected platforms
• Retrieve content metadata and performance data on your behalf
• Store technical metadata (file names, sizes, scheduling info) required to operate the service

You represent and warrant that you own or have all necessary rights to the content you upload and that publishing it via PulsePeak does not violate any third-party rights or applicable laws.

7. Acceptable Use

You agree NOT to use the Service to:

• Publish content that violates any law or third-party rights
• Engage in spam, harassment, or coordinated inauthentic behavior
• Bypass any platform's rate limits, security measures, or content policies
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use the Service to publish illegal, hateful, or sexually explicit content where prohibited by the destination platform

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, third-party API outages, or other technical issues. We are not liable for missed scheduled posts caused by third-party API failures.

9. Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms or applicable law. Upon termination, your data will be deleted according to our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, PulsePeak Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. The "Effective Date" at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws of Germany. Any disputes shall be resolved in the competent courts of Germany.
